A federal judge has granted a seven-day postponement in the release of a redacted appendix from a legal brief challenging former President Trump's immunity from prosecution. On Thursday, the judge approved the release of this evidence, which is linked to a brief by Special Counsel Jack Smith, disputing Trump’s claim of immunity in his federal election case.
The redacted appendix forms part of Smith’s 165-page brief, which argues that Trump can be prosecuted for attempting to overturn the 2020 election, despite the U.S. Supreme Court's ruling that presidents have some immunity for official acts. The brief accuses Trump of orchestrating a fraudulent electors scheme, misleading state officials, and pressuring former Vice President Mike Pence not to certify the election results. Smith asserts that none of these actions are protected by presidential immunity, and that Trump’s scheme was private rather than part of his official duties.
In her ruling, U.S. District Judge Tanya Chutkan found the prosecutors' proposed redactions appropriate and noted that Trump’s defense had not raised any specific objections to them. She also dismissed the defense’s broader objections to unsealing the information, stating that concerns about political consequences did not constitute a valid legal argument.
Judge Chutkan granted a temporary stay on the decision, giving Trump's legal team seven days to review their legal options. Trump had previously opposed the release and had requested a reasonable delay if the court ruled in favor of the disclosure.
Trump's lawyers, in an October 10 filing, argued that the Special Counsel’s office had misrepresented evidence during early voting for the 2024 election, claiming that the filing lacked legal basis. Smith's office had redacted sensitive materials, including grand jury transcripts and witness interview reports, and proposed additional redactions for certain publicly available information, particularly to protect individuals mentioned in Trump’s tweets who could face threats.
Trump’s legal team has not yet commented on the matter.
